In a vote held in the state Legislature last night – Monday, January 14, 2013 – the Second Amendment Constitutional freedoms of New Yorkers were weakened with passage of restrictive new gun control. I strongly opposed this legislation that was rushed through both houses of our state Legislature without a single public hearing or the proper time to carefully review the bill.
Law-abiding citizens are NOT the issue! Millions of New Yorkers own firearms and do so safely, responsibly and legally. The real issue, the real threat, is dangerous criminals having guns and the seriously mentally ill obtaining access to guns.
Monday’s vote was only the beginning, not the end, of a critically important debate. I believe we must repeal and replace the restrictive parts of the enacted legislation. We should focus on increasing penalties for criminals who use firearms and addressing the issue of mental illness. However, I cannot do it alone: I need strong Second Amendment supporters like you to stand strong – and stand with me.

Gun Ownership is a Civil Right, Not a Crime
On January 15th, 2013 The Safe Ammunition and Firearms Enforcement Act was passed in New York State, (in the dead of night, rushed and under undue special interest political pressure, with no public input or review). The law contains approximately 70 pages of regulations and restrictions in regard to firearms and ammunition.
This law is unconstitutional. The second amendment of the US constitution states, “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”
One need not be a lawyer or justice of the court to see that this law violates the principles set forth by the supreme law of the land, the US Constitution.

Something to think about….
Though the report starts out listing mass shootings as the justification for increase gun control legislation, the number of homicides resulting from mass shootings is conspicuously absent from the data presented. This is likely because this highly emotional subject accounts for a very small number of the firearms related deaths in this country.
It does discuss Fast and Furious.
In the Background and Analysis, Pro Con Debate states the pro-gun control people believe the 2nd Amendment is being misread. Note that the date of this report is November 2012; the SCOTUS ruled that the 2nd Amendment is an individual right in DC vs. Heller in 2008. The author is choosing to ignore a very recent SCOTUS decision or at the very least he is choosing not to educate himself on the subject; either act is unprofessional in my book.
Also, note in this section how we are referred to as “opponents of gun control” instead of something positive like “proponents of gun rights”. This subtly steers us into a defensive position. We shouldn’t be pushed into the defensive position as our opinions are not wrong.
Paragraph 4 of this section states that “Some argue that the low violent crime rates of other countries have nothing to do with gun control….” This statement ignores that there are several countries with much stricter gun control than the U.S. that also have more violent crime issues per the International Crime Victimization Study. Not all countries responded to the questionnaires either, such as Russia which reportedly has a high level of violent crime while under strict gun control. Paragraph 5 notes that we argue for our right of self-defense. Conspicuously absent from the data tables, in my opinion, if the FBI’s Uniform Crime Report which supports the gun right’s theory that more gun control equals more crime.
If you look at Figure 1, you’ll see that firearms are involved in half or less of the total murder rate so why aren’t gun control proponents focusing on the other half of the equation. Perhaps they should propose hand amputation for anyone found guilty of felonious fisticuffs or blunt object beatings.
Note in Table 2 that half or more of firearms-related deaths are from suicides, the number of which has remained relatively unchanged from 1993 through 2009. Through the same period gun related homicides have gone down 37%; seems like that ugly mental health thing is again rearing its little head. Am I the only one who thinks that crime problems and suicide problems are totally different entities? I expect most of those that choose to commit suicide are aware that there are many other means available to them. It may be time to outlaw bridges, tall buildings, any sharp utensils , rope, engines the produce carbon monoxide, any medication for which an overdose of results in death, etc. Their access to firearms is a moot point in my opinion.
The last column in Table 2 lists the percent change from year to year for overall fire-arms related deaths, which indicates single digit ups and downs. Why isn’t there a cumulative percent change column, perhaps so things don’t sound too rosy? Calculate the percent change between 1993 and 2009 and you’ll see it’s over 20%. Essentially this entire reduction is due to the reduction in gun homicide rates though some credit goes to reduced gun accidents. Thus one can construe that the suicide numbers are merely used to cloak reality by watering down the overall percentage of change; as President Obama and Governor Cuomo shamelessly cloak themselves in dead children to promote their personal agendas.
In Table 3, Firearms-Related Deaths for Juveniles homicides and suicides are down by over 50% and accidents are down by 80%, cumulatively from 1993 through 2009. Seems like good news. However, one column that I would like to see here is how many of the homicides were gang related. Once a juvenile joins a gang, I no longer consider him/her to be a juvenile; the line has been crossed.
And this is just from the parts that I looked into a bit. The report’s rather lengthy.

An important message regarding any and all cities and other municipalities in America: Proposed Law Would Fine Ohio Cities Into Obeying Firearms Laws

To allow such laws would make the exercise of second amendment rights a legal minefield, as it would be practically impossible to keep up with hundreds of variations in the law that could make a perfectly legal act on one side of the street a serious crime on the other side.
Cleveland challenged the law in 2010, claiming that “home rule” prevented the state from restraining the cities power. The Ohio supreme court upheld earlier rulings in favor of state authority to protect second amendment and state constitutional rights.
Many local governments continued to keep laws that infringed on second amendment rights on the books, producing a chilling effect on the exercise of those rights. A provision in the statute provided for the recovery of costs and attorney’s fees when cities were sued, to provide incentive for them to follow the law.
Several cities changed their local ordinances as a result. But some cities learned to exercise a loophole in the law in order to discourage further lawsuits. They refused to change the law, fighting the effort in court until the last minute, wasting city resources and costing those challenging their illegal practices as much money as possible. Then, before a court ruling was made, they would repeal the statute, preventing the plaintiff from recouping any costs or attorney’s fees.
As part of a number of reforms Ohio gun laws proposed in House Bill 203, the bill would change to law to close this loophole.
Once sued, cities would be subject to a $100 a day fee if they lost the lawsuit or repealed the ordinance.
While $100 a day is only a fraction of the cost of one city worker per day, it provides some reimbursement of the costs of funding the lawsuit and provides and incentive to prevent the city from delaying the action as long as possible.
Other reforms included in House Bill 203 include reform of Ohio self defense law to bring it into concurrence with most other states (Stand Your Ground provision), and reforms of the Ohio Concealed Carry permit law.

Homeowner Shoots Home Intruder To Death In East Islip, NY (Guns Save Lives of the Innocent – Kill the Guilty!)

Philipe Robinette, fled but in custody (credit: Suffolk County Police Department) A home invasion on Long Island turned deadly for one of the suspects early Wendesday morning. Police told WCBS 880 reporter Sophia Hall that a gunman and two other suspects forced their way inside a two-story, yellow-colored home on Adams Street in East Islip around 2 a.m. Once inside the home, the suspect armed with a .22 caliber rifle shot the family’s pit bull. A man who lives in the home, grabbed a shotgun and returned fire, police said. One suspect, identified by police as Fred Flock, 27, of Coram, died on the back porch. Another suspect was wounded and hospitalized, police said. A third suspect, identified as Philipe Robinette, 27, of Aquebogue, fled the scene but was later caught by authorities. It’s a law that News10NBC has heard so many complaints from many of you. The SAFE Act bans assault weapons and limits the number of rounds in a magazine among other things. News10NBC has solid numbers on how many jobs are leaving the state because of it. Governor Cuomo says it’s all about making our communities safer, but when we asked him last month about jobs moving out of state because of the law, he didn’t completely agree. After our first story aired, we heard from a number of gun shops and manufacturers who say the SAFE Act restrictions have taken away 50 percent or more of their business and for some, moving out of the state was a must if they wanted to stay in business. The losses add up to hundreds and even one job gone is having a big ripple effect. Amanda Ciavarri asked, “Hundreds maybe thousands of jobs in upstate New York have been lost because of the New York Safe Act. It is driving gun retailers and gun manufactures across the border to Pennsylvania.” Governor Andrew Cuomo said, “Yeah, I don’t think that is correct on the facts.” Hundreds of jobs have already left the state. American Tactical in the Rochester area is closing its shop, packing up and heading to South Carolina. It started the moving process last month. The company says it is partially moving because it wants to be located in a gun friendly state. So what is New York losing? The New York City Police Department is taking aim at owners of certain shotguns and rifles, telling them all long guns with more than a five-round capacity must be tåçurned in, altered or taken out of town.
The first option for the letter’s recipient is to, “Immediately surrender your Rifle and/or Shotgun to your local police precinct, and notify this office of the invoice number. The firearm may be sold or permanently removed from the City of New York thereafter.”
An estimated 500 recipients of the notices, which were mailed on Nov. 18, were given the options to surrender their gun, permanently move the gun out of city jurisdiction or employ a licensed gunsmith to modify the weapon to get into compliance with the law. Rifles and shotguns with a capacity of five or more rounds are affected.
An NYPD spokeswoman told FoxNews.com the initiative has been in practice since 2010.
But this year is the first time critics say the notices were so widely dispersed. The notice was first reported on the website TheTruthAboutGuns.com.
“These letters appear to be another example of the Nanny State. Hypothetically, it can start with a letter, and then that can lead to someone knocking on your door saying, ‘I want to see your gun.’”

New York State has the strictest gun laws in the country. Mayor Michael Bloomberg, co-founder of Mayors Against Illegal Guns, has made it a priority of his to pull illegal handguns off the streets and directly links these guns to violent crimes. But critics say the real problem is illegal handguns in the hands of criminals, not long guns owned by law-abiding citizens.
“We think it’s an abuse of power by the NYPD,” said Tom King, the president of New York State Rifle & Pistol Association. His organization has fought with the state on various gun bills and spent $400,000 on a lawsuit challenging the Secure Ammunition and Firearms Enforcement Act, or SAFE Act, which was signed in January by Gov. West Virginia Leads 27 States,Territories in Supreme Court Brief Supporting Citizens’ Rights to Buy, Sell Guns!

Attorney General Patrick Morrisey today announced that West Virginia and 25 other states and one territory have filed an amicus, or friend of the court, brief with the U.S. Supreme Court opposing a federal government attempt to prosecute legal gun owners who wish to sell a weapon to another person who can legally own and purchase firearms.
“Our Office is proud to lead a bipartisan group of 27 states and territories in this brief to oppose the U.S. Department of Justice’s attempt to unilaterally create a federal restriction on firearm sales between law-abiding citizens,” Attorney General Morrisey said. “We believe that every legal gun owner in this state and nation should be interested in the outcome of this case.”
The case, Abramski v. United States of America, challenges whether federal law prohibits citizens who legally buy a firearm from a licensed dealer with the intention of then selling that gun to another private citizen who also may legally own and purchase firearms. The Obama administration argues that the citizen who buys and then sells the gun is acting as a “straw purchaser,” which they claim is illegal under several federal statutes.
The States, however, argue that Congress has never passed a federal law that prohibits such purchases. At most, the laws relied on by the United States prohibit private citizens from selling guns to people who are prohibited from owning firearms, such as minors, convicted felons, or people who have been diagnosed as having mental illnesses. It is up to the States and their citizens to decide whether to implement additional regulations on private gun sales.
West Virginia is joined in this brief by attorneys general representing Alabama, Alaska, Arizona, Arkansas, Florida, Georgia, Guam, Idaho, Indiana, Kansas, Kentucky, Louisiana, Michigan, Missouri, Montana, Nebraska, New Mexico, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Texas, Utah, Virginia, and Wyoming.
“This case is important to West Virginia citizens who wish to practice their Second Amendment rights and sell firearms to other legal West Virginia gun owners,” Morrisey said. “The State of West Virginia does not discourage private gun sales, but the Department of Justice wants to ensnare innocent West Virginian gun owners in a web of criminal laws if they try to sell their guns. This federal overreach is a blatant attempt to overstep state regulations and Congress in order to steer more gun sales to federally licensed dealers, who then make federal records of every transaction.”
The states’ amicus brief is in support of a former Roanoke, Va., police officer, Bruce Abramski, who purchased a gun in 2009 using a law enforcement discount and sold it to his elderly uncle, who lived in Pennsylvania. Both Abramski and his uncle could legally own firearms and made the transaction in accordance with Pennsylvania gun laws, including a background check of the purchaser. However, federal authorities prosecuted Abramski on the grounds that he made false statements on the gun purchase form.
In January 2013, the U.S. Court of Appeals for the Fourth Circuit upheld Abramski’s conviction, saying that such “straw purchases” are illegal under federal law. In October, the Supreme Court agreed to review the conviction.
“Our Office is very concerned about the federal government’s targeting of law-abiding gun buyers,” Morrisey said. “The federal government is attempting to circumvent Congress and set aside state regulations that don’t prevent private gun sales, and instead make sure there is a federal record of every gun bought or sold in the United States. While no one wants guns to end up in the hands of a potential or real criminal, the administration’s interpretation oversteps the law and could make criminals out of innocent citizens.”
Oral arguments are scheduled for Jan. 22, 2014, with a decision to come by the end of the court’s session in June.

New York City Mayor and gun control advocate Michael Bloomberg sure knows how to get his way. This week the NFL, after featuring anti-gun ads during the last two Super Bowls, it decided that an ad offering the opposite point of view in the upcoming Super Bowl XLVIII on February 2 was just too much. The NFL turned down an ad from a company called “Daniel Defense” which sells guns and outdoor gear that discussed “personal protection and fundamental rights.” It featured a former Marine talking his family’s safety, noting that he is ultimately responsible for their protection. Unlike Bloomberg’s ads, the “Daniel Defense” ad never even mentions the word “gun,” just the concept of personal protection. The very end of the initial version of the ad did show the company’s logo, a picture of a gun. But this wasn’t the stumbling block, as the company told the NFL that it would happily to remove the logo and replace it with a picture of an American flag. Still the NFL found that unacceptable.

Many anti-freedom politicians are using the Newtown shooting to exploit our Second Amendment right to keep and bear arms. The shining star in all this has been our county sheriffs, elected by the people. They are the supreme law enforcement in our counties. Many have vowed to uphold their oaths of office, and will refuse to enforce any unconstitutional gun control laws that will only disarm the law-abiding.
Now these freedom-loving sheriffs are under attack for defending OUR freedom – the freedom from an oppressive, tyrannical government.

New York Governor Andrew Cuomo (D) and state legislative leaders have now publicly admitted mistakes in their rush to pass what is arguably the worst gun control law in the country – the SAFE ACT. After intense public pressure, the state’s chief executive and lawmakers discussed including amendments to the SAFE Act this week during the state budget negotiations. Specifically, much of the focus was on the seven-round magazine limit. However, the prospects for making the law more lenient disappeared when a rough budget agreement was reached this week. Governor Andrew Cuomo, in stunningly brazen fashion, took a hatchet to gun rights in New York with lightning speed. By cutting secret deals behind closed doors, eliminating public input and circumventing normal legislative processes, the Governor and state Senate passed sweeping anti-gun measures just before the stroke of midnight yesterday. Within 24 hours, Cuomo had his new gun control laws. Cuomo utilized a rarely-used executive trick, a “message of necessity” to bypass normal legislative procedures that are strictly followed on hundreds of bills each legislative session. Late last night as the clock approached midnight, the public was introduced to S. 2230,a hastily drafted bill that includes bans on commonly owned semi-automatic firearms and magazines, registration, and restrictions on ammunition purchases. This bill was released to legislators a scant twenty minutes prior to the Senate vote and quickly passed without proper vetting, committee consideration and debate, as previously reported on here. Just before midnight and within minutes of the bill text becoming available to the public, the New York Senate passed radical anti-gun legislation late last night. Without any committee hearing or testimony, without public comment or even proper legislative procedure, anti-gun Governor Andrew Cuomo and legislative leaders, including Senate Republican Leader Dean Skelos and Assembly Speaker Sheldon Silver have cut a deal and sacrificed your constitutional rights that they swore to protect. As a result, the state Senate passed S.2230 by a 43-18 vote and the Assembly will vote on it today.
Secretary of State John Kerry signed the United Nations Arms Trade Treaty on behalf of the Obama administration. The National Rifle Association strongly opposes this treaty, which is a clear violation of the Second Amendment to the U.S. Constitution. FULL STORY

NOT EXACTLEY- The law redefined the term Assault Weapon from being a fully automatic machine gun to any Semi-Automatic Weapon that resembled a military firearm or had certain scary looking features. The reporter mentioned if you had them before the law you would have to register them. Neglecting to mention that you could keep it until the day you die, at which point that piece of your private property would have to be turned into the State Police Gun Squad.

Not Exactly. Mental Health Professionals not just Doctors have to report certain criteria. 10 thousand reports have been collected by the State Police Gun Squad and 60 were license handgun owners. Could a member of your family be one of the 9960 others?
As the report goes on, pay close attention to the Senator Michael Gianaris from Queens.
He uses the buzz word started by the anti’s “Bazooka” . Then he goes on to talk and makes himself look totally ignorant of the law other than the talking points.. All you can do is shake your head and wonder how did someone so stupid in come to be in office.
Finally the reporter catches up with Cuomo.
The look on his face is priceless. He starts to babble about Reasonable gun control blah blah is the 1 step “Second Amendment Rights. YES. But not for criminal and people who are mentally ill.”
What kind of answer was that? Translated: How did she get in here. Somebody is gonna get it.

It’s True: Government is Aggressively Engaged in Gun Confiscation In the US
A report from TruthAboutGuns.com is claiming that New York gun owners are being sent letters from the N.Y.P.D. demanding them to surrender their guns which have feeding capacities that violate the 5–round rule.
Below is an excerpt from the New York Ammunition and Firearms Enforcement Act (NY SAFE Act).
According to Kit Daniels, “The New York Police Department is now sending out notices to registered gun owners demanding that they give up their firearms, clear proof that gun registration leads to outright confiscations.”
Earlier this year, Canadian journalist Brian Lilley from Sun News warned Americans during his broadcast that gun “registration will lead to confiscation.”
Lilley described how the Canadian government systematically confiscated firearms from law abiding citizens: (1) create a national gun registry to track the sales of firearms, (2) pass laws that ban certain firearms, (3) notify gun owners that they have 30 days to surrender their registered firearms to local police.
New York lawmakers have been lobbying for gun confiscation both locally and nationally. Assemblyman Steve McLaughlin (R) exposed N.Y. lawmakers’ plans to confiscate firearms earlier this year, see video below.
In an interview, N.Y. Governor Andrew Cuomo stated that gun “confiscation could be an option,” regarding new gun control laws. Now gun owners are seeing his promise of gun confiscation unfolding before their eyes.
In April, the California state legislature passed a bill approving $24 million in order to confiscate an estimated 40,000 handguns and semi-automatic firearms from felons and those who the state deems emotionally unfit to own firearms.
California uses paramilitary teams called Armed & Prohibited Persons System (APPS) to inspect homes and confiscate firearms.
Former DOJ Special Agent, Greg Cameron told Ginny Simone that the majority of those people targeted in these raids should not have been targeted.
Cameron said, “95% to 98% of the firearms we confiscated, I really questioned why we were confiscating them. This whole freakin’ APPS thing is not doing anyone any good. This has amounted to nothing less than “gun confiscation under the guise of safety.”
Cameron described what they would do in a typical raid in order to enter a home without a warrant.
“We would show up with way too many agents for the circumstance, and it didn’t make any sense; there was no need for it. And yeah, the whole place would be surrounded, and absolutely, there’s an intimidation factor there that makes people allow — or think that they need to allow — law enforcement into their house. And if we found out there were guns in the house, then we would confiscate them. I think it is, overbroad, overreaching. I think it’s confiscation under the guise of safety. That’s absolutely what I think it is. And I think this is the crux of the whole issue. You need to know what you can and can’t do when confronted with law enforcement, especially in your own home. I mean, that’s the premise of the Fourth Amendment,” Cameron said.
